1. Purpose

These Terms of Use (“Terms”) govern access to and use of the Guestin™ platform, which is owned and operated by Guestin EE. The platform connects accommodation providers (hotels and short-term rentals) with local cafés/restaurants for the provision of breakfast to guests via QR codes.

3. Acceptance of Terms

By accessing or using the Guestin™ service, the user (accommodation provider, café/restaurant, or guest) confirms that they have read, understood and unconditionally accept these Terms, as well as Guestin's Privacy Policy. If the user does not accept these Terms, they must refrain from using the platform.

4. Obligations of Accommodation Providers

Partner accommodation providers are required to:
  • Provide accurate and up-to-date booking information
  • Issue and send vouchers/QR codes in a timely manner, exclusively to legitimate, registered guests
  • Comply with the terms of their commercial partnership agreement with Guestin
Responsibility for the correct and timely issuance and delivery of vouchers to guests rests exclusively with the accommodation provider.

5. Obligations of Cafés / Restaurants

Partner cafés/restaurants are required to:
  • Correctly validate QR codes prior to serving breakfast
  • Maintain a consistent standard of quality and service in the breakfast provided
  • Comply with Guestin™'s operating policies and commercial agreements
Responsibility for the quality, service, and overall execution of the breakfast rests exclusively with the partner café/restaurant.

6. Obligations of Guests

Guests are required to:
  • Make correct, personal use of the QR codes assigned to them
  • Refrain from unlawfully sharing or transferring QR codes to third parties

7. Financial Terms

Fees, commissions, and other financial terms of the partnership between Guestin, accommodation providers, and partner cafés/restaurants are set out in the relevant Partnership Agreement signed between the parties and do not form part of these Terms.

8. Limitation of Liability

Guestin EE operates exclusively as the provider of the technology platform connecting accommodation providers, cafés/restaurants, and guests, and is not involved in the provision of breakfast or in the hospitality relationship between accommodation provider and guest. It is expressly clarified that Guestin EE bears no liability whatsoever for the following:
  • The quality, service, composition, food safety, or any other aspect of the breakfast provided: sole responsibility rests with the partner café/restaurant providing the service
  • The correct and timely issuance and delivery of vouchers/QR codes to guests: sole responsibility rests with the accommodation provider, who is responsible for managing its own bookings
  • Incorrect or inaccurate information provided by accommodation providers, cafés/restaurants, or guests
  • Damages not attributable to its own wilful misconduct or gross negligence
Any claim relating to the quality or non-provision of breakfast should be directed exclusively to the partner café/restaurant, while any claim relating to the non-issuance or non-delivery of a voucher should be directed exclusively to the accommodation provider. The platform is provided “as is”, without warranty of uninterrupted or error-free operation, to the extent permitted by applicable law.

9. Intellectual Property

All content of the Guestin™ platform (including, without limitation, logos, trademarks, text, software, and design) constitutes the intellectual and industrial property of Guestin EE or its licensors and is protected under applicable intellectual property law. Reproduction, distribution, or modification without Guestin's prior written consent is prohibited.

10. Data Protection

The processing of personal data in connection with the use of the platform is governed by Guestin™'s Privacy Policy, which forms an integral part of these Terms.

11. Force Majeure

Guestin EE shall not be liable for any delay or failure to perform its obligations to the extent such delay or failure results from events of force majeure beyond its reasonable control.

12. Termination

Guestin EE may suspend or terminate a user's access to the platform, immediately and without prior notice, in the event of a breach of these Terms or of the commercial partnership agreement.

13. Amendments

Guestin EE reserves the right to amend these Terms at any time. Amendments take effect upon publication on the platform, and continued use of the platform following publication constitutes acceptance of the amended Terms.

14. Governing Law & Jurisdiction

These Terms are governed by Greek Law. The Courts of Athens shall have exclusive jurisdiction over any dispute arising in connection with these Terms or the use of the platform.
